Extending unit's garden

I own a unit in Auckland with a 500m2 AU garden, it is one of nine units with the majority on the land attached exclusively to mine. I am wondering if it is possible to extend my property or whether the building boundaries are set in stone?

Our Experts Answer:

You may be able to extend the building into the AU. However it is a process that will require you to approach the body corporate with a design and get approval. The council will have to approve a resource consent and a variation to the subdivision consent which will enable the unit title for the whole property to be modified. However, all of the costs associated with the various paperwork requirements for the adjustment to the unit title can often make the process of doing an addition cost prohibitive.
