On 6th January 2010 Kathryn asked:

Am I under any obligation to pay commission?
I want to sell one of my investment properties but before I list it I want to give the tenants the opportunity to buy it, therefore avoiding agents commission on the sale.
If my property is tenanted and managed by a letting agent am I under any obligation to pay any commission i.e. is this viewed as an introduction to a potential buyer? I don't think I do but I wanted to check. I plan to contact the tenants prior to listing with an agent.

Our expert Kim Matheson responded:

You are correct if the Tenant wishes to purchase the property it will be by private treaty. The Letting Agent is only looking after the property management side.  You would only pay commission to an Agent once you have signed a Listing Authority.

Property Conveyancing Services are all about taking the hassle out of your property conveyancing needs and the efficient and professional settlement of your property.
